These Terms of Service (“Terms”) govern your access to and use of falconstallion.market and your purchase of products offered through the website.
The Store is operated by Falcon and Stallion Groups LLC (“Falcon & Stallion,” “we,” “us,” or “our”).
By accessing the Store, placing an order, or otherwise using the Services, you agree to these Terms and to the policies incorporated into them, including our Privacy Policy, Shipping & Pre-Order Policy, and Returns & Refunds Policy.
1. Online Store
Our Store is hosted using Shopify's ecommerce platform.
You may use the Store only for lawful purposes and in accordance with these Terms.
You may not use the Store in a way that interferes with its operation, attempts to gain unauthorized access to systems or accounts, introduces malicious code, commits fraud, infringes intellectual-property rights, or violates applicable law.
2. Eligibility
By placing an order, you represent that you are legally capable of entering into the transaction or have the consent required by applicable law.
3. Products
We make reasonable efforts to describe products accurately.
Because products offered through the Store may incorporate natural materials, small-batch production, handcrafted processes, vintage materials, or other ingredients that naturally vary, minor differences may occur between batches or individual units.
Product photographs and colors displayed on a screen may also vary depending on lighting, photography, packaging revisions, and device settings.
4. Fragrance Descriptions
Fragrance descriptions, note listings, impressions, stories, comparisons, performance descriptions, and similar information communicate the creator's artistic or sensory impression of a product.
Olfactory perception is inherently subjective.
We do not guarantee that every customer will perceive a fragrance, note, ingredient, intensity, longevity, projection, or development in the same manner.
5. Product Safety and Use
Fragrance products should be used only for their intended purpose.
Unless a product expressly states otherwise:
- products intended for personal fragrance use are for external use only
- avoid contact with eyes and other sensitive areas
- keep products away from children and pets
- do not ingest fragrance products
- discontinue use if significant irritation occurs and
- alcohol-based fragrances should be kept away from flame, sparks, heat, and other ignition sources.
Customers with known sensitivities should review available ingredient or allergen information and use appropriate caution before use.
Nothing on the Store is intended to provide medical advice.
6. Prices
Prices are displayed in the currency indicated by the Store.
We may change prices at any time for future purchases.
Changes will not retroactively alter the price of an order already accepted by us except where correction is permitted by law, such as in the case of an obvious pricing error.
Taxes and other charges, where applicable, may be calculated during checkout.
7. Orders
Submitting an order does not necessarily mean that we have accepted it.
We reserve the right, where lawful, to refuse or cancel an order for reasons including:
- suspected fraud or unauthorized payment
- pricing or inventory errors
- product unavailability
- shipping restrictions
- suspected resale or abusive purchasing activity
- inability to verify necessary order information or
- circumstances that make fulfillment impracticable or unlawful.
If we cancel an order after payment has been collected, we will refund the amount paid for the cancelled portion.
8. Limited Releases and Quantities
Certain products may be produced or released in limited quantities.
We may impose reasonable per-customer or per-household quantity limits and may cancel orders that reasonably appear designed to circumvent those limits.
Availability is not guaranteed until an order is accepted and fulfilled.
9. Pre-Orders
Certain products may be made available for purchase before they are ready for immediate shipment.
Each pre-order product page will identify the product as a pre-order and provide the applicable estimated shipping date, shipping window, release period, or other fulfillment estimate.
Pre-order shipping estimates may vary from one release to another.
By placing a pre-order, you acknowledge that fulfillment will occur at a later date and that the stated timeframe is an estimate.
If an estimated fulfillment timeframe materially changes, we will handle the affected order in accordance with our Shipping & Pre-Order Policy and applicable law.
10. Shipping and Delivery
Shipping is governed by our Shipping & Pre-Order Policy.
Customers are responsible for providing accurate delivery information.
11. Returns and Refunds
Returns, exchanges, cancellations, and refunds are governed by our Returns & Refunds Policy.
Where applicable law provides rights that cannot legally be waived or restricted by these Terms, those rights remain unaffected.
12. Intellectual Property
Unless otherwise indicated, the Store and its original content—including text, product descriptions, photographs, graphics, designs, logos, trademarks, trade dress, and other materials—are owned by or licensed to Falcon & Stallion or the applicable rights holder.
No content from the Store may be copied, reproduced, republished, distributed, commercially exploited, or used to create derivative materials without permission from the applicable rights holder except as permitted by law.
Product and brand names belonging to third parties remain the property of their respective owners.
13. Third-Party Services and Links
The Store may contain links to third-party websites, services, payment processors, social platforms, or other resources.
Third parties operate under their own terms and privacy practices.
We are not responsible for third-party content or services except to the extent required by applicable law.
14. Reviews and User Submissions
If you submit reviews, photographs, comments, feedback, or other content to us or through features of the Store, you represent that you have the right to submit that material and that it does not violate applicable law or the rights of another person.
We may moderate or remove unlawful, fraudulent, abusive, infringing, or otherwise inappropriate submissions.
15. Errors and Availability
Information on the Store may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, availability, or shipping information.
We may correct such errors and update information as appropriate.
Nothing in this section permits us to disregard an accepted transaction or consumer right where applicable law requires otherwise.

To the maximum extent permitted by applicable law, the Store and its informational content are provided on an “as available” basis.
We do not guarantee that access to the Store will always be uninterrupted or error-free.
Any warranties that cannot legally be excluded remain in effect notwithstanding anything in these Terms.

To the fullest extent permitted by law, Falcon & Stallion will not be liable for indirect, incidental, special, consequential, or punitive damages arising solely from use of the Store or matters outside our reasonable control.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including mandatory consumer rights.

To the extent permitted by law, you agree to be responsible for losses reasonably arising from your unlawful misuse of the Services, violation of these Terms, or infringement of the rights of another person.

Our collection and processing of personal information is described in our Privacy Policy.
20. Changes to These Terms
We may update these Terms to reflect changes in our business, Services, technology, or legal requirements.
The revised Terms will be posted on the Store with an updated revision date.
Changes will not retroactively alter completed transactions except where required or permitted by law.
21. Governing Law
These Terms are governed by the laws applicable in the State of California, without regard to conflict-of-law principles, except where the mandatory consumer laws of another jurisdiction apply.
Nothing in these Terms deprives a consumer of protections that cannot legally be waived.
22. Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.

These Terms, together with the policies expressly incorporated into them and any product-specific terms disclosed before purchase, constitute the agreement governing use of the Store and purchases through it.
